All contracts formed between LV Martin & Son and the customer are
governed by New Zealand Law, and specifically the Commerce Act 1986(NZ), the
Fair Trading Act 1986 (NZ), the Consumer Guarantees Act 1993(NZ) and the Sale
of Goods Act 1908(NZ).
Acceptance of Terms and Conditions
When you access this site you acknowledge that you have read and agree to the
terms set out below. If you do not agree to the terms as set out below you
should refrain from using the site.
Product availability
Due to the constant release of new products, our site will be amended so to
reflect these changes. Products will be added and removed on a regular basis.
Occasionally, products on this site may not be available, and some products may
not be held in stock. LV Martin & Son does not accept liability for any
loss arising. Every effort will be made to keep the information displayed on
the site accurate and up-to-date.

Your legal rights will be preserved and honoured. No attempt will be made to
diminish or to reduce you legal rights

If you buy from us and then find that you could have bought the same product
elsewhere with the same service on the same terms:

If the product supplied is not of the type requested, it must either be
replaced or be taken back.
Your right to receive satisfactory goods
Product must be in a condition or on terms relating to its condition that is
entirely satisfactory to you or:

It must be made satisfactory by repair, or an allowance or

Your right to receive functioning goods
If a supplied product does not function the way it is designed to function, then
it must be repaired, replaced or taken back.
Your right to receive Instruction
You will be given all the help needed to use your new product

Including manufacturers guarantees
Your right to service
After sales service will be available.
Spares will be stocked or obtained
If we cannot supply a part or for any reason cannot service your appliance we
will share the cost of a new appliance with a new guarantee. The proportion of
the cost we meet is determined by the age of the appliance.
We will provide service
We will provide service within our service boundaries
However, we cannot service distant locations. We cannot have direct control
over provision of after sales service beyond our geographic service areas.
We service the Greater Wellington region, as far north as Levin in the
west and Kaitoke in the east.
If goods we supply are either taken by you or sent by us outside our service
boundary then even if home service has been paid for, the following applies.

We cannot unpack or install

We cannot promise to provide an in house demonstration

Guarantee service may not be carried out by our own staff

Service may only be provided during normal commercial hours

You may have to return the good to us for service

We may not be able to offer you an extended warranty

After the guarantee expires you arrange for service or return the goods to us
for service

We cannot rescue frozen food in the event of a freezer failure

We may not be able to provide you with a loan appliance whilst yours is being
repaired.
Your right to exchange within 14 days
Any product (excluding personal hygiene and grooming products, games, DVD's and
software) can, within 14 days be changed for the same or different product
providing it is returned in the condition it was supplied, with packaging.
Your right to a full refund within 14 days
Any product (excluding personal hygiene and grooming products, games, DVD's and
software) still in the condition which it was supplied with packaging can be
returned within14 days for a full refund of purchase monies.
Your right to exchange for up to 60 days
Any product (excluding personal hygiene and grooming products, games, DVD's and
software) will be accepted back within 60 days of purchase, for credit of the
purchase price or the current price whichever is the lower, providing the goods
are in as new condition and are used as a credit towards an appliance worth at
least 1/3 more.
Your right to return or exchange goods at any time
Any product (excluding personal hygiene and grooming products, games, DVD's and
software) will always be accepted back for a partial refund. The refund will be
calculated by deducting from the current cash price or the price paid,
whichever is lesser, a weekly hire charge based on the purchase price paid.
Your right to trust promises we make will be honoured
If you tell me about any promise that is not honoured, then I will promptly

Make sure the promise is honoured or, if this is not possible

Arrive at a solution which is fair and satisfactory to you and us
Your right to protection
LV Martin has a Public Liability insurance policy in place, protecting
customers against loss or damage to themselves or their property due to any
negligence or accident caused by any person working for LV Martin & Son
Your right to ethical dealing
All transactions will be of the highest ethical standard or will be rescinded.
Insurance
If you have bought or are buying then as soon as you accept an invoice or
account you become responsible for the insurance Goods sold on credit terms are
not insured if you do not pay a separate charge for insurance. If there is a
charge for insurance we will arrange for it, in all other cases you are not
covered by our insurance
Your right to my personal attention.
I am available during working hours on (04) 496 9899. I will give matters my
personal attention when requested to do so.

When you purchase from LV Martin & Son, it is agreed that:
The customer will be supplied with an invoice that

Lists the goods and services the customer wants and highlights their rights

Details the credit and/or payment method the customer prefers
The customer is not committed to buy
But if the customer does decide to buy, rent or hire then the invoice
establishes the terms and conditions.
LV Martin & Son is not committed to supply
But if LV Martin & Son does supply, the customers rights and the
conditions are highlighted on their invoice.
Rights are retained by LV Martin & Son
Goods will only be supplied on the understanding that until such time as the
customer enters an agreement to purchase the goods remain the property of LV
Martin & Son. For any supply of goods to a business, the goods remain
the property of LV Martin & Son until they are paid in full.
Credit is granted only on conditions
Credit is only granted when the customer has satisfied all of LV Martin &
Son credit requirements.
LV Martin & Son may repossess its goods

When a trial or loan period has ended and the customer has not entered into an
agreement to buy, rent or hire the goods

When LV Martin & Son believes its goods are likely to be moved, damaged
or disposed of without the permission of LV Martin & Son
The customer gives LV Martin &Son the right
To gain access to the goods by whatever means are necessary in order to
repossess them.
Should the customer not meet the repayment terms
If the customer does not meet the repayment terms of the agreement, LV Martin
& Son will charge the customer all reasonable costs associated with the
recovery of any outstanding amounts, along with interest of 1.5% per month on
any outstanding amount that is not otherwise charged interest.
Customers have obligations
When the customer has possession of goods that LV Martin & Son owns

It is the customers responsibility to take good care of the goods

The customer will when requested , advise LV Martin & Son of the
location of the goods and give LV Martin & Son access to them
Purchase for business use
For any purchase for business or commercial use the consequential loss
provisions of the Consumer Guarantees Act 1993 do not apply
Commercial use of the site

The LV Martin & Son website is protected by copyright. You may print out
documents or pages for your individual / company use, but no unauthorised
distribution or making available to the public (whether in print or electronic
form) of any data contained within this website is permitted without prior
written consent from LV Martin & Son
